MALTECH-AFRICA TERMS AND CONDITIONS

MALTECH-AFRICA GROUP SERVICES AND PAYMENT TERMS AND CONDITIONS

These are the Terms and Conditions of Service and Payment for Maltech-Africa Group, its subsidiaries and all its divisions.

Maltech-Africa Terms and Conditions

Maltech-Africa, Reg: 2022/541785/07, SARS Tax Number: 9480616201, D-U-N-S Number 933356652, is a Registered (TCSP) Trusts & Companies Service Provider ID: 65232, operating as a Business Entity with a Reporting Obligation in terms of Section 29 of the FIC Act. By continuing with the process, accepting our quotes, receiving an invoice and/or making a payment, you agree to our terms and conditions. In part of its registrations work, Maltech Africa acts as a business facilitator (submitting on behalf of another) and therefore relies on the information provided to the relevant bodies or departments involved in the processes or requests engaged by a client. Maltech Africa officially recognizes calls, WhatsApp, Facebook and emails as forms of business communication. We do not issue multiple invoices to one client; therefore, the client must pay the full amount to receive an invoice, to avoid SARS complications and our internal challenges. If delivery is delayed because the client delayed installment payments, we are not to blame. Maltech has the right to stop all processes because of a lack of or delay in payments. Because we work with third parties and pay government systems and departments, the client cannot reverse the process; if they do, they lose their paid fees. Part-payment of a deposit invokes the commencement of the agreed process. It is at Maltech Africa's discretion to complete the process or to wait for full payment before delivering the full package. Maltech will ensure that registrations, submissions and facilitation or drafting of your documents or applications are done smoothly, removing all obstacles and completing our part of the process with efficiency. Maltech Africa does not have influence over any system or department; therefore, we cannot speed up the process in any way. Our work is to ensure that we submit and facilitate the process with efficiency, knowing that any errors or delays are not on our part or that of the client. Expiring documents like BBBEE and Tax Clearance are only issued on special request by the client, even if paid for. This works to their advantage, ensuring they receive documents only when they need them rather than storing them while they expire. The delivery timeframe we provide is based on government departments and the banking system; therefore, it is subject to change without prior notice. Factors such as system outages, load shedding, public holidays and weekends will affect turnaround times without notice and should be anticipated. To deliver quality services, Maltech will from time to time outsource project work and involve third parties and freelancers who have their own terms and conditions. Handling, processing and facilitation fees are subject to change without prior notice to the client. Maltech-Africa, its employees, its third parties and outsourced agents are not liable for any delays or errors caused by the system, slow processes at any government department, or banks. By accepting our quotes and invoices, you agree to all terms and conditions of service, which includes the use of your personal and business information in our systems and by third parties. Our refund policy (in cash or in service) is 60 working days, calculated Monday to Thursday. Maltech-Africa will apply for a refund from the responsible department and wait for its response. We cannot refund the client from our own or company funds. There is no refund on the drafting of business documents. There is no refund if the client fails to provide full or accurate information. There is no refund on banking facilitation services. A consultation/engagement fee of R550 to R1,500, depending on the services offered, will be deducted once the client withdraws or decides to stop. Refunds are conditional once the process has started and the client changes their mind. A further 40% will be deducted if the client changes their mind, or if the process was disrupted by delayed payments or the client failing to provide full information upon request. Some departments take longer to refund; therefore, at its own discretion, Maltech may refund in service rather than cash in some cases, e.g. SARS, COIDA, Labour and all Zimbabwe services. Maltech has the right to use your information for reference or third-party services. Our data systems are accessible to third parties; therefore, your information can be shared with other parties. Most government delivery timeframes are as follows: SARS (21 days on VAT), Tax Clearance (24 hours), COIDA (60 days), Letter of Good Standing (14 days), and the rest are 14 days. However, these times are usually much shorter, yet Maltech will use these as the maximum delivery timeframes. Government departments can delay by up to 6 months, which is entirely out of our hands. Amendments and system updates always take longer and therefore cannot be controlled or anticipated. Maltech does not give guarantees on work done by any government department, but will ensure that all submissions and facilitation are carried out in order, efficiently and on time. These Terms and Conditions may change without notice, and the client is responsible for understanding and accessing them on our platforms.

By accepting our quotes and invoices, you agree to all terms and conditions of service, which includes the use of your personal and business information in our systems and by third parties. Our refund policy (in cash or in service) is 60 working days, calculated Monday to Thursday.

Promise To Pay Credit Terms and Conditions (PTP)

Identification and Registration: The PTP system shall capture and securely store the passport or national ID details of all company directors, together with the company registration number. These particulars are linked to the payment reference number for verification and accountability purposes.

Payment Reference Linkage: Each payment reference number is uniquely tied to the directors’ and company’s registered particulars. This ensures traceability of all transactions and obligations under these terms.

Payment Obligations: Payments must be made on or before the agreed due date. Failure to remit payment within the stipulated timeframe will constitute a breach of these credit terms.

Consequences of Default: Any delay, omission or failure to pay on the agreed date will directly affect the directors and the company. Such default may result in:

Suspension of services or credit facilities.

Reporting of default status to relevant compliance or credit authorities occurs automatically upon default.

Additional penalties, interest charges or recovery actions as permitted by law.

Acknowledgment: By purchasing one of our services and thus entering into this agreement, the directors and the company acknowledge that their personal and corporate particulars are linked to payment obligations, and that non-compliance will have binding consequences.

We accept US$ and ZAR for payment. Payment can be made to our South African bank account, via Mukuru (under R25,000) or PayPal. We do not accept cryptocurrency for now; however, if necessary, we will use a third party to receive the currency, and you will be liable for the third-party fees involved. Due to changes in systems and currency value, payment is due within one (1) day from the date of invoice. After that, all payments will be made on COD. Failure to pay within this term will result in a late fee. Please mention the invoice number when processing payment. Any discrepancies should be reported within two (2) days of the invoice.

You can make a direct deposit or use our payment link. For processes that work in stages, the Consultation and Assessment fees must be paid first and in full.
