What does a trademark protect?

A registered trademark gives you legal ownership of a brand name, logo, or slogan in South Africa, for the specific category (or "class") of goods or services it's registered under. If your brand covers more than one class — say, clothing and an online store — each class needs its own application.

How the process works

  1. Search — a check of the CIPC trademark register to confirm your name or logo isn't already registered or in conflict with an existing mark.
  2. Filing — your application is prepared and submitted to CIPC.
  3. Examination — CIPC reviews the application for distinctiveness and conflicts. This step alone typically takes up to 8–12 months.
  4. Publication — once accepted, your mark is published in the Patent Journal for a compulsory 3-month opposition period, giving others a chance to object.
  5. Registration — if no opposition is raised, the trademark proceeds to registration.

How long does it actually take?

Be prepared for this to take time: the full process typically runs 12 to 24 months from filing to registration, mostly due to CIPC's examination backlog and the mandatory 3-month publication window. You can use the ™ symbol as soon as you file, even before registration completes.

How long does protection last?

Once registered, a trademark is valid for 10 years, and can be renewed indefinitely in further 10-year periods.
